• The Privacy Act 1988 (Cth) (the “Privacy Act”) allows personal information to be collected, used and disclosed for the purpose for which it was collected, and otherwise in accordance with the Privacy Act. This Privacy Policy only applies to the extent that Grantham Property Pty Ltd trading as Grantham Buyers Agents (the “Agent”) collects, uses and discloses personal information. This Privacy Policy may be revised and/or updated from time to time by the Agent by written notification to the Client.
  • The personal information the Client provides to the Agent in connection with this Agreement or collected from other sources is necessary for the Agent to identify and verify the Client; act on behalf of the Client in accordance with this Agreement; arrange inspections and reports in respect of properties the Client is interested in; negotiate on behalf of the Client; liaise and exchange information with the Client and each of the Agent’s and Client’s professional advisors in relation to a prospective purchase; assist with the exchange of contracts on behalf of the Client; comply with any applicable law or regulations; contact and liaise with goods and services providers as instructed by the Client and to provide those providers with the Client’s personal information; and otherwise perform the Agent’s obligations under this Agreement. If the personal information is not provided by the Client, the Agent may not be able to carry out these functions.
  • The Agent will take reasonable precautions to protect the personal information it holds from misuse, loss, and unauthorised access, modification or disclosure.
  • The Agent may disclose personal information to other parties including the Agent’s and the Client’s professional advisors, advertising and media organisations, property data service providers, prospective and actual vendors of any property, property inspection service providers, clients of the Agent both existing and potential, tradespeople, strata owners corporations, valuers, government and statutory bodies, financial institutions and other third parties as instructed by the Client (including, without limitation, goods and services providers) or as required by any applicable law.
  • The Agent may also use the Client’s information including personal information for marketing purposes to inform the Client of products and services provided by the Agent, which the Agent considers may be of value or interest to the Client, unless the Client instructs the Agent in writing not to do so.
  • The Client has the right to request access to any personal information held by the Agent which relates to the Client, unless the Agent is permitted by law (including the Privacy Act) to withhold that information. Any requests for access to a Client’s personal information should be made in writing to the Agent. The Agent may charge a fee where access to personal information is provided (no fee may be charged for making an application to access personal information). The Client has the right to request the correction of any personal information which relates to the Client that is inaccurate, incomplete or out-of-date.
  • By engaging the Agent, accessing the Agent’s website and/or otherwise dealing with the Agent, the Client will be deemed to have read and understood these permissions to collect, use and disclose personal information and the Client authorises the Agent to collect, use and disclose personal information, in accordance with the Privacy Act, for the purposes specified above.
